All Phenom Football registrations are nonrefundable, and refunds will not be issued. 

Any program completely canceled by Phenom Football, the customer will be refunded, excluding software platform and processing fees.

Should a customer need a refund due to an unforeseen circumstance (ie. injury or emergency), Phenom Football will issue a credit for participation in a future program.

Phenom Football reserves the right to cancel or transfer any program based on insufficient enrollment. 

In the rare event there is not enough participation to run a certain location, Phenom Football will contact each customer directly via email and phone call and provide you with the nearest location options. If we do not hear back within 48 hours, we will automatically transfer the customer to the nearest location of play.

**COMBINED WAIVER OF LIABILITY AND IMAGE/LIKENESS RELEASE AGREEMENT FOR FTBL, LLC**

**PLEASE READ CAREFULLY! THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS.**

**I. RELEASE AND WAIVER:**  

In consideration of my access to activities and services provided by FTBL, LLC (hereafter “Phenom FTBL”), including but not limited to participation in events, camps, combines, and other athletic or educational activities (collectively “Activities”), I, the undersigned, HEREBY FOREVER RELEASE, WAIVE, DISCHARGE, AND HOLD HARMLESS Phenom FTBL LLC, its successors, affiliates, partners, directors, officers, employees, agents, and contractors from any and all liability, claims, demands, actions, causes of action, costs, expenses, and attorney fees arising out of or in any way related to any loss, damage, or injury, including death, that may be sustained by me, or any property belonging to me, as a result of my participation in the Activities, WHETHER CAUSED BY THE NEGLIGENCE, RECKLESSNESS, OR INTENTIONAL ACTS OR OMISSIONS of Phenom FTBL, or otherwise.

**II. CONSENT AND ASSUMPTION OF RISK:**  

I acknowledge that participation in the Activities involves inherent risks, including risk of physical injury, illness, or death. I FULLY ACCEPT, CONSENT TO, AND ASSUME ALL RISKS associated with these Activities. I agree to take full responsibility for any injury or loss I may suffer, not exceeding my physical capabilities. I agree to inform Phenom FTBL immediately of any injury or medical condition affecting my participation.

**III. INDEMNIFICATION:**

I agree to indemnify and hold harmless Phenom FTBL against all liabilities, claims, and expenses arising from my actions or omissions during participation in the Activities.

**IV. ACCOMMODATION RELEASE AND INDEMNIFICATION:**  For any accommodations provided or arranged by Phenom FTBL, I release Phenom FTBL from liability and agree to indemnify them against losses due to my actions or negligence.

**V. CONSTRUCTION AND GOVERNING LAW:**  

This Release and Waiver is governed by the laws of the jurisdiction where Phenom FTBL LLC is based. Ambiguities in this document shall be construed in favor of a broad release and waiver of liability.

**VI. SEVERABILITY:**  

Should any provision of this Release and Waiver be found unenforceable, the remainder shall remain in effect.

**Youth Participant Media Waiver Form**

**Waiver Language:**  

I, the undersigned parent or legal guardian (“Guardian”), hereby grant FTBL, LLC (“Phenom FTBL”) and its affiliates the irrevocable and unrestricted right to use, reproduce, and publish any photographs, video recordings, or other media content (“Content”) captured during Phenom FTBL’s events, including but not limited to youth flag football and 7 on 7 football programs, featuring the minor child (“Participant”) named below. This authorization includes the right to edit, alter, or modify the Content for use in promotional materials, advertisements, or any other purpose deemed appropriate by Phenom, without compensation to Guardian or Participant.

Guardian acknowledges that Phenom FTBL shall be the sole owner of all rights, title, and interest in and to the Content, including any intellectual property rights therein. Guardian hereby releases Phenom FTBL and its affiliates, officers, directors, employees, agents, and representatives from any and all claims, demands, or liabilities arising out of or in connection with the use of the Content as described herein.

Guardian understands and agrees that this authorization shall remain in effect indefinitely, unless revoked in writing by Guardian and acknowledged by Phenom. Guardian further understands that revocation of this authorization shall not affect any rights or permissions granted to Phenom prior to the date of revocation.
